Trustees

In specific cases, trustees may consult the Individual Credit Register (ICR).

In this regard, a distinction is made between trustees appointed to act on behalf of a protected person (also known as “guardians”) and trustees appointed to manage the assets of a protected person (also known as “conservators”):

  • Guardians: exercise of the rights referred to in the Act of 30 July 2018 on the protection of natural persons with regard to the processing of their personal data (or the Act of 8 December 1992 on the protection of privacy with respect to the processing of personal data)
  • Conservators: the performance of acts of daily management

A trustee who wishes to consult the Individual Credit Register (ICR) must submit the appointment order issued by the court along with a signed request. The order shall mention the cases in which the trustee is entitled to represent the person concerned. A trustee will only be allowed to consult the ICR if the judgment grants the trustee “powers of representation”.

The procedure to be followed by trustees is as follows:

Trustees for a protected person (guardians)

Guardians are authorised to consult the data recorded in the ICR pertaining to the protected person whose interests are represented. To do so, the guardian must be able to present the following documents:

  • the full order issued by the justice of the peace, clearly establishing that the guardian is authorised to exercise the rights defined in the Act of 30 July 2018 on the protection of natural persons with respect to the processing of personal data (FR-NL);
  • a request signed by the guardian.

Please note that the requested data will be sent only by post, to the guardian’s legal address.  

Trustees for the assets of a protected person (conservators)

The procedure to be followed is very similar to that applicable to guardians. The conservator must be able to present the following documents:   

  • the order in full issued by the justice of the peace, clearly establishing that the conservator is authorised to carry out acts of daily management;
  • a request signed by the conservator.

Please note that the requested data will be sent only by post, to the conservator’s legal address.
